Terms and Conditions
All goods supplied by Australian Research Alliance for Children and Young People (ARACY), ABN 68 100 902 921, are sold on the following terms:
Prices
All prices quoted by ARACY are processed in AUD, include GST and are subject to change without prior notice.
Delivery Charges
Delivery costs, where applicable, are calculated automatically, based on your location.
Delivery
Deliveries will be dispatched by ARACY to the address provided by the customer as soon as practicable after receipt of an order. Items will be dispatched once processed. Delivery dates or times indicated at the time of the order placement (if any) are approximate only and do not constitute a guarantee of delivery by such date. If an order contains a number of goods that cannot all be immediately supplied, ARACY may amend the order, in respect of the goods that cannot be supplied immediately, and no claim will arise due to the shortfall. Goods that cannot be supplied immediately will be placed on back order and supplied as soon as possible. Customers will receive an email once items are dispatched, with a tracking number.
Payment
Payment in full is required before goods will be shipped. Payment on invoice can be requested for businesses. The customer is responsible for any taxes, duties or levies charged. Good will not be shipped and eLearning access will not be provided until the invoice has been paid unless otherwise advised by ARACY.
Refunds
Refunds will be considered case by case and in line with Australian Consumer Law.
Refunds for Digital Content
We do not offer refunds for digital content or eLearning subscriptions, except where required under the Australian Consumer Law (ACL If your digital content is faulty, not as described, or does not function as expected, ARACY will endeavour to replace or refund where appropriate and in line with Australian Consumer Law.
Credit/Returns/Claims
Goods are supplied by ARACY on a sale basis only, not on approval. Returns will not be accepted for a change of mind by the customer.
In the event of incorrect items delivered or damaged goods the customer must notify ARACY as soon as possible after receipt of the goods or within 14 days of date of invoice. ARACY is not responsible for return shipping charges unless advised otherwise. Please note we are unable to refund the initial postage and handling fee except in the case where the item is damaged, faulty or has been delivered incorrectly.
Returned items will only be accepted if received by ARACY in full saleable condition, with no marks or damage. Returns within Australia must be made within 14 days of date of invoice and must be approved for return by ARACY before sending.
Claims for failure of receipt of ordered goods, excluding subscriptions, must be made within 14 days of receipt of the goods. ARACY may decline further claims where it reasonably believes the claims are excessive, unfounded, or not made in good faith, in accordance with ACL.
Discounts
From time to time ARACY may offer discount codes or special offers. These offers cannot be used in conjunction with any other promotions, discounts, or voucher codes, unless explicitly stated otherwise. The discount applies only to the product price and does not cover shipping fees, which will be calculated and charged separately at checkout.
ARACY reserves the right to modify, extend, or discontinue these offers at any time without prior notice. Website prices are subject to change at short notice. In the event of a pricing conflict between this communication and the website, the website price will apply.

Other matters
The Terms of Trade set out the sole obligations and liability of ARACY to customers in relation to orders, except where the law prevents ARACY from excluding or limiting its liability. Where our goods are not of a kind ordinarily acquired for personal, domestic or household use or consumption, ARACY limits its liability to the maximum extent permitted under the Competition and Consumer Act 2010 (Cth).
Goods:
- The replacement of the goods or supply of equivalent goods.
- Payment of the cost of replacing goods or of acquiring equivalent goods.
ARACY will use its reasonable endeavours to perform its obligations under these terms of trade but will not be liable for any failure to deliver ordered goods where such a failure is as a result of an act of terrorism, an act of God, strike, lockout or other interference with work, war (declared or undeclared), blockade, disturbance, lightning, fire, earthquake, storm, flood, explosion, governmental or quasi-governmental restraint, expropriation, prohibition, intervention, direction or embargo, unavailability or delay in obtaining governmental or quasi-governmental approvals, consents, permits, licences, authorities or allocations, and any other cause, whether of the kind specifically enumerated above or otherwise which is not reasonably within the control of ARACY.
No variation of these Terms of Trade is binding on ARACY unless approved in writing by ARACY. If ARACY fails to enforce a term of these terms and conditions, this will not affect the rights of ARACY, except to the extent that ARACY expressly waives such a term in writing.
Limitation of Liability
Nothing in these Terms excludes, restricts or modifies any rights you have under the Australian Consumer Law. Where permitted, our liability is limited to:
- the replacement of the goods or supply of equivalent goods; or
- payment of the cost of replacing the goods or acquiring equivalent goods.

These Terms of Trade are governed by the laws of the Australian Capital Territory, Australia.
